Terms of Sale

1. Scope

These Terms of Sale ("Terms") apply to all training programs sold by H5 AI Academy through the website https://h5-ai.com, to consumers and professionals alike. Enrolling in a program constitutes full and unconditional acceptance of these Terms, which prevail over any other document unless expressly agreed otherwise in writing.

2. Training Programs

H5 AI Academy offers continuing training programs focused on artificial intelligence, delivered live online. Each program has a dedicated page describing its content, duration, format, level, and price. Program content may be adjusted between sessions to reflect developments in AI tools and practices, without affecting the overall learning objectives.

3. Prices

Prices are displayed in euros (EUR), inclusive of all taxes where applicable. The price applicable to an enrolment is the price displayed at the time of payment. H5 AI Academy reserves the right to change its prices at any time; changes do not affect enrolments already confirmed.

4. Enrolment Process

Enrolment is completed by filling in the enrolment form on the website with accurate personal, professional, and scheduling information, then proceeding to payment. Enrolment is only final once payment has been successfully processed.

5. Payment

Payment is made online, in full, in a single instalment, through our payment provider Stripe, using a secure checkout page. H5 AI Academy does not have access to and does not store card details; all payment data is processed directly by Stripe in accordance with PCI-DSS standards.

6. Confirmation

Once payment is confirmed, a confirmation email is sent to the address provided at enrolment, along with a payment receipt. This confirmation includes the program purchased and, where applicable, the dates and times of the scheduled live sessions.

7. Access to Online Sessions

Programs are delivered live online via a video conferencing tool. Access details (link and instructions) are sent by email ahead of each session, to the email address provided at enrolment. Participants are responsible for checking their inbox (including spam folders) and for informing H5 AI Academy of any change of email address.

8. Customer Cancellation

A participant may cancel their enrolment under the conditions described in our Refund Policy. Cancellation requests must be sent to contact@h5-ai.com.

9. Cancellation by H5 AI Academy

H5 AI Academy may cancel or reschedule a session for reasons including insufficient enrolment, unavailability of the instructor, or force majeure. In that case, affected participants are notified as soon as possible and offered, at their choice, a transfer to another session or a full refund.

10. Right of Withdrawal

If you are a consumer within the meaning of the French Consumer Code, enrolling for non-professional purposes from the European Union, you benefit from a 14-day right of withdrawal from the date of enrolment, without having to give any reason, in accordance with Articles L.221-18 et seq. of the French Consumer Code. If you expressly request that the training begin before the end of this 14-day period, you acknowledge that your right of withdrawal will be extinguished once the training has been fully performed, and reduced proportionally to the content already delivered if you withdraw after it has started. This right of withdrawal does not apply to enrolments made by professionals for purposes directly related to their professional activity.

11. Refund Conditions

Refund conditions are detailed in full in our Refund Policy, which forms an integral part of these Terms.

12. Intellectual Property

All content made available as part of our training programs — including presentations, videos, exercises, templates, and written materials — is the exclusive property of H5 AI Academy or its licensors and is protected by intellectual property law. Enrolment grants participants a personal, non-exclusive, non-transferable right to use this content for their own learning purposes only.

13. Prohibition of Recording, Copying, Sharing or Reselling Course Content

Participants may not record, screen-capture, copy, reproduce, distribute, share, publish, or resell any part of the training content — including live sessions, slides, and materials — without the prior written consent of H5 AI Academy. Any breach of this provision may result in immediate exclusion from the program without refund, without prejudice to any further legal action.

14. Participant Responsibilities

• Provide accurate and up-to-date information at enrolment
• Attend sessions in good faith and with a genuine intent to learn
• Behave respectfully toward instructors and other participants
• Not use the training content for any unlawful or commercial purpose

15. Technical Requirements

Attending a live online session requires a stable internet connection, a computer or tablet with a working camera and microphone, and access to the video conferencing tool used for the program. H5 AI Academy cannot be held responsible for connectivity issues on the participant's side.

16. Liability

H5 AI Academy's training programs are provided for educational purposes and are intended to build practical skills; they do not guarantee any specific professional, business, or financial outcome. H5 AI Academy's liability is limited to direct damages resulting from a proven breach of its obligations, and to the amount actually paid for the relevant program, to the extent permitted by law.

17. Force Majeure

Neither party may be held liable for total or partial non-performance of its obligations if such non-performance results from a force majeure event as defined by French case law and Article 1218 of the French Civil Code.

18. Personal Data

Personal data collected during enrolment is processed by H5 AI Academy in accordance with our Privacy Policy, which describes the data collected, its purposes, and your rights under the GDPR.

19. Complaints

Any complaint relating to a training program or an order may be sent to contact@h5-ai.com. H5 AI Academy undertakes to acknowledge receipt within 5 business days and to provide a substantive response within 30 days.

20. Governing Law

These Terms are governed by French law. In the event of a dispute, the parties will first seek an amicable resolution. Failing that, and subject to any mandatory consumer protection rules applicable to your place of residence, the competent French courts shall have jurisdiction.
